GrailGreens towels are intended solely for the cleaning and maintenance of golf equipment. GrailGreens water bottles are intended solely for personal hydration. Use of either product for any other purpose constitutes misuse. While these are sports-related items, no product can guarantee absolute protection against injury or property damage during athletic activities.
ALL PRODUCTS ARE SOLD “AS-IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. GRAILGREENS DISCLAIMS ALL SUCH WARRANTIES TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW.
Limitation of Liability
IN NO EVENT SHALL GRAILGREENS’ TOTAL LIABILITY TO YOU EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE. GRAILGREENS SHALL NOT BE RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, PROPERTY DAMAGE, OR PERSONAL INJURY OCCURRING ON OR OFF THE GOLF COURSE, ARISING FROM THE USE OR MISUSE OF OUR PRODUCTS.
Health and Safety Warnings (Specific to Water Bottles)
GrailGreens water bottles are intended for hydration only. Use of water bottles for any purpose other than personal hydration is considered misuse. GrailGreens is not liable for any bodily injury or property damage arising from the improper or unintended use of any GrailGreens product.
Intellectual Property and Use Restrictions
All logos, designs, and content displayed on this website are the proprietary intellectual property of GrailGreens and may not be reproduced, distributed, or used for commercial purposes without prior written permission.
GrailGreens is not responsible for the content, accuracy, privacy policies, or practices of any third-party websites linked to and from this site. Access to any third-party website is at your own risk.
Terms & Conditions — General
This website is owned and operated by GrailGreens. These Terms set forth the conditions under which you may use our website and services. By accessing or using this website, you agree that you have read, understood, and agree to be bound by these Terms.
To use this website and/or receive our services, you must be at least 18 years of age, or the legal age of majority in your jurisdiction (whichever is greater), and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website if doing so is prohibited under any law or regulation applicable to you.
When buying an item, you agree that: (i) you are responsible for reading the full item listing before committing to purchase; and (ii) you enter into a legally binding contract to purchase an item when you complete the checkout payment process.
The prices we charge for our products are listed on the website. We reserve the right to change our prices at any time and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
We may, without prior notice, change, suspend, or discontinue any aspect of the services or products offered. We may permanently or temporarily terminate or suspend access to the services for any reason, or for no reason.
When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. GrailGreens will pay for the shipment of repaired or replaced products to the customer and is responsible for the return shipment to us.
You agree to indemnify and hold GrailGreens, its owners, employees, and agents harmless from any demands, losses, liabilities, claims, or expenses (including reasonable attorneys’ fees) made against them by any third party due to, or arising out of, your use of the website or any services or products offered on the website.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRAILGREENS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRAILGREENS ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (i) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (ii) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE WHATSOEVER RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; OR (iii) UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.
We reserve the right to modify these Terms at our sole discretion. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the website after any such change constitutes your acceptance of the new Terms.
Marketing Communications & Opt-Out
You may receive promotional messages and materials from us by mail, email, or phone (including calls or text messages) if you have provided your contact information. You may opt out of marketing communications at any time by: (i) clicking the “unsubscribe” link in any marketing email; (ii) replying STOP to any marketing text message; or (iii) emailing Welcome@GrailGreens.store with “UNSUBSCRIBE” in the subject line. Opt-out requests will be honored within 10 business days.
Governing Law, Venue & Dispute Resolution
These Terms, and any claims or disputes arising hereunder, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
DISPUTE RESOLUTION BY BINDING ARBITRATION: Any dispute, claim, or controversy arising out of or relating to these Terms or the use of this website that cannot be resolved through good-faith negotiation within 30 days shall be resolved exclusively by binding individual arbitration administered by JAMS in Volusia County, Florida, under its Streamlined Arbitration Rules then in effect. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

CLASS ACTION WAIVER: YOU AND GRAILGREENS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN, COMMENCE, OR RECOVER DAMAGES IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts of Volusia County, Florida, to prevent irreparable harm pending arbitration.
T&C Overview
Access to customer personal information is restricted to authorized GrailGreens personnel on a need-to-know basis. Although GrailGreens utilizes a certified Wix website creator/designer, that individual’s access is limited to website design permissions only and does not extend to customer data. Payment methods include Apple Pay and online credit/debit card payments processed through our third-party payment processor.
GrailGreens reserves the right at any time to modify or discontinue the service (or any part or content thereof) without notice. GrailGreens shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the products or services offered.
GrailGreens offers a 30-day return policy for unused items returned in their original condition with proof of purchase. GrailGreens provides its products on an “AS-IS” basis.
TO THE FULLEST EXTENT PERMITTED BY LAW, GRAILGREENS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Ownership of all GrailGreens brand assets, logos, and intellectual property may not be reused for commercial purposes without prior written permission from GrailGreens.
